This Privacy Policy does not pertain to information collected on any other site owned by Rubens Blanc, its subsidiaries or other businesses, nor does it extend to the privacy practices (or lack thereof) of third parties. Rubens Blanc cannot and does not assume responsibility for the policies, practices and actions of such third parties. Those who choose to access the Site do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. By using this Site, visitors from outside of the United States of America acknowledge this Site is subject to the laws and regulations of the United States of America, and waive any claims that may arise under their own national laws.

The Information We Collect About You

Information you give us. This is information about you that you give us by:

• Third Party Communications. 

• Service Providers. We work with third parties who provide services including but not limited to data analysis, order fulfillment, credit card processing and other services of an administrative nature. If you use our services, we reserve the right to share your Personal Information with such third parties for the purpose of enabling these third parties to provide such services. We take reasonable steps to ensure these third parties treat Personal Information in a manner comparable to how we do so.

• Online Surveys/Sweepstakes and Contests. If we administer a promotion or marketing event on the Site in conjunction with a third party (a “Promotion”), you grant us the right to share Personal Information collected in connection with such Promotion with the third party partner if you decide to participate in such Promotion or otherwise in accordance with the rules applicable to such Promotion, which will be made available to you. • Assignment. We reserve the right to transfer any and all information that we collect from users of the Site to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Rubens Blanc ’s business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings). • Collection of Information By Third Parties

• Co-Branded Pages. We may enter into relationships with “powered by” partners, business partners, sponsors, and co-branded sites (referred to here as “co-branded pages”). These might include, for example, pages that share our name and that of another entity. You should look for a specific privacy policy on any such co-branded page. Any Personal Information that you provide when signing up at any co-branded page may be collected by, or shared with, our third-party partner. We have no control over, and are not responsible for, our partners’ use of your Personal Information. You should check our posted partners’ websites for information regarding their privacy policies.

• Transactions With E-Commerce Partners, Vendors and Advertisers. When you provide Personal Information to one of our Site’s e-commerce partners, vendors or advertisers, this transaction will occur in connection with the site of the e-commerce partner, vendor or advertiser, not on the Site, and, as such, the Personal Information you provide is collected pursuant to and controlled by the privacy policy of such e-commerce partner, vendor or advertiser. • Please be aware that at times, at the request of or on behalf of our e-commerce partners, vendors or advertisers, Rubens Blanc may “pre-populate” forms with your Personal Information for your review, and, if you so choose, for submission to such e-commerce partners, vendors or advertisers. Accordingly, we encourage you to review each pre-populated form carefully before agreeing to submit your Personal Information to determine who is seeking to collect your information, and to familiarize yourself with the applicable privacy policy governing use of any Personal Information collected about you.

• Job Postings. If you choose to respond to a job posting on the Site, you may be directed to a third-party site (for example, a third-party site specializing in job postings, such as Monster.com). Any Personal Information you provide will be collected by such third party. We have no control over, and are not responsible or liable for, such third party’s use of your Personal Information. Please consult such third party’s privacy policy for information regarding their privacy practices.

• The third party collecting your Personal Information will share such Personal Information with Rubens Blanc so that Rubens Blanc can review your information and, if applicable, respond to your query or job application. Please note that Rubens Blanc has no obligation to respond to all queries or job applications submitted. Any Personal Information that Rubens Blanc receives from such third party will be treated in accordance with this Privacy Policy.

• Third Party Advertising. The ads appearing on this Site are delivered to you by our Web advertising partner. Non-Personal Information about your visits to this Site, such as number of times you have viewed an ad, is used to serve ads to you. In the course of serving advertisements to this Site, our third-party advertiser may place or recognize a unique cookie on your browser.

• Third Party Links. The Site may contain links to third-party Internet websites, which are not owned or operated by Roc Nation. We provide such links only as a convenience, and the inclusion of a link on the Site does not imply endorsement of the linked site by Rubens Blanc . We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

PLEASE READ THIS TERMS OF USE AGREEMENT CAREFULLY BEFORE USING THIS SITE.

This Terms of Use Agreement (the “Agreement”) states the terms and conditions under which you may use Noir 4 Park (the “Site”). This Agreement is legally binding made by and between Rubens Blanc Management, LLC (“Rubens Blanc,” “Noir 4 Park,” “we,” “us”), a limited liability corporation, existing under the laws of the State of New Jersey, and you. By accessing, browsing and/or using the Site, you acknowledge that you have read, understood, and agreed to the following Agreement. If you do not accept this Agreement, do not access, or use the Site.
 

PRIVACY
Our Privacy Policy governs what information we collect from you, how we use the information, and with whom we share that information. We have the right to collect, share and use your information in accordance with our Privacy Policy, which is incorporated by reference in these Terms.

GENERAL PRACTICE AND LIMITS
You acknowledge that Rubens Blanc may establish general practices and limits concerning use of the Site, including without limitation, the maximum throughput of traffic from the Internet or associated service (e.g., email, web hosting), and the maximum number of times (and the maximum duration for which) you may access the Site in each period. You agree that Rubens Blanc has no responsibility or liability for the deletion of, for failure to store or to deliver any messages and other communications, for the modification or malformation of data communications over the Site, or for other content maintained or transmitted by the Site.

RESTRICTIONS ON USE
The information and materials provided on or through the Site, including any data, text, designs, graphics, images, photographs, illustrations, audio and video clips, logos, icons and links (collectively, the "Materials"), are intended to educate and inform you about Rubens Blanc's mission, programs, events and other information offered or described on the Site. Although Rubens Blanc strives to provide Materials that are both useful and accurate, the nature of the data and other information contained on the Site is subject to frequent change. In addition, the facts and circumstances of every situation differ. Accordingly, although Rubens Blanc endeavors to use reasonable care in assembling the Materials, the Materials may not be up-to-date, accurate or complete. Accordingly, we reserve the right to:

• Change the terms and conditions of this Agreement; or 

• Change the Site, including eliminating or discontinuing any content on or feature of the Site.

 
You may not engage in any unauthorized use, copying, or distribution of any of the Materials. For example, you may not otherwise reproduce, display, publicly perform, or distribute the Materials in any way for any public or commercial purpose. You may not alter or modify any part of the Site other than as may be reasonably necessary to use the Site for its intended purpose. Modification or use of the Materials for any purpose is a violation of our copyright and other proprietary rights and is strictly prohibited.

COLORS
We have made every effort to display as accurately as possible the colors of our products that appear at the Site. We cannot guarantee that your computer monitor’s display of any color will be accurate. 

SITE TRANSACTIONS
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

CODE OF CONDUCT
You agree to respect the rights of others and exercise good judgment in using the Site. You agree that you will not:

• Engage in spamming or flooding;

• Transmit any software or other materials that contain any viruses, worms, Trojan horses, defects, date bombs, time bombs or other items of a destructive nature;

• Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the Site;

• Remove any copyright, trademark or other proprietary rights notices contained in the Site;

• "Frame" or "mirror" any part of the Site without our prior written authorization;

• Use any robot, spider, offline reader, site search/retrieval application or other manual or automatic device or process to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Site or its contents without our prior written consent. Notwithstanding the foregoing, Rubens Blanc IP Holdings LLC grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. We reserve the right to revoke these exceptions generally or in specific cases;

• Harvest or collect information about Site visitors;

• Take any action that imposes an unreasonable or disproportionately large load on our infrastructure; or

• Violate any applicable local, state, national or international law, rule or regulation, including, without limitation, regulations promulgated by the U.S. Securities and Exchange Commission or any rules of any other

The Site may contain links to other Internet websites, including affiliated websites which may or may not be owned or operated by Rubens Blanc. We have not reviewed all the websites that may be linked to the Site, and Rubens Blanc has no control over such sites. Unless otherwise explicitly stated, Rubens Blanc is not responsible for the content of such websites, any updates or changes to such sites, or the privacy or other practices of such sites, and the fact that we may offer such links does not indicate any approval or endorsement of any material contained on any linked site. Such links may be provided to you only as a convenience. Accordingly, we strongly encourage you to become familiar with the terms of use and practices of any linked site. Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from the Site or other sites) is free of such items as viruses, worms, Trojan horses, defects, date bombs, time bombs and other items of a destructive nature.

OWNERSHIP
The Site, including all Site software, databases, proprietary information, and Materials (and any intellectual property and other rights relating thereto) including, without limitation, the selection, sequence and "look and feel" and arrangement of items, logos and trademarks is owned and operated by Rubens Blanc in conjunction with others pursuant to contractual arrangements, and will remain the property of Rubens Blanc and its licensors and suppliers (as applicable). The Site is protected by U.S. and international copyright, trademark, and other laws, and you acknowledge that these rights are valid and enforceable. You further acknowledge that you do not acquire any ownership rights by accessing the Site or the Materials.

RULES FOR SWEEPSTAKES, CONTESTS AND GAMES
In addition to the terms and conditions of this Agreement, any sweepstakes, contests, games, or similar promotions (collectively, "Promotions") made available through the Site, if any may be governed by specific rules that are separate from this Agreement. By participating in any such Promotion, you will become subject to those rules. Rubens Blanc urges you to review any specific rules applicable to a particular Promotion, which will be linked from such Promotion, and to review our Privacy Policy, which, in addition to this Agreement, governs any information you submit in connection with such activities. Promotion rules will control over any conflict with this Agreement.

MODIFICATION, SUSPENSION AND TERMINATION
We reserve the right at any time to suspend, modify or discontinue, temporarily or permanently, any portion of the Site with or without cause and with or without prior notice. You agree that we will not be liable to you or to any third party for any suspension, modification, or discontinuance. Any violation by you of this Agreement may result in corrective action by us, in our sole discretion, including disconnection or discontinuance of your participation, or termination of this Agreement.

THE SITE, THE MATERIALS ON THE SITE, AND ANY PRODUCT OR SERVICE OBTAINED THROUGH THE SITE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, Rubens Blanc IP Holdings LLC, ITS AFFILIATES, OFFICERS, LICENSORS, SUPPLIERS, ADVERTISERS, SPONSORS AGENTS, CONSULTANTS, PARTNERS, EMPLOYEES, EMPLOYEES’ PARTNERS, DIRECTORS, SHAREHOLDERS, EXECUTIVES, AND RESPECTIVE FOUNDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SITE, THE MATERIALS, AND ANY PRODUCT OR SERVICE OBTAINED THROUGH THE SITE, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. 

Rubens Blanc, our affiliates, licensors, suppliers, advertisers, sponsors, and agents do not warrant that your use of the Site will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Site, the server(s) on which the Site is hosted is free of viruses or other harmful components. You acknowledge that you are responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed to access and use the Site, and all charges related thereto. 

You assume all responsibility and risks for your use of the Site and your reliance thereon. No opinion, advice or statement of Rubens Blanc or its affiliates, officers, licensors, suppliers, advertisers, sponsors, agents, members, or visitors, nor their respective founders, owners, shareholders, executives, directors, officers, employees’ partners, consultants, agents, or other representatives whether made on the Site or otherwise, shall create any warranty. Although we attempt to ensure the integrity of the Site, we make no guarantees as to the Site's completeness or correctness.
